Participation Rules

Age. Minimum age is 13, subject to fit and ability to safely operate the controls. Participants under 18 require a parent or legal guardian to sign this waiver on their behalf.

Sobriety. No alcohol, cannabis, or recreational drugs before or during your simulator use. Any violation will result in refusal or immediate termination of the session.

Health exclusions. The experience involves rapid physical movement, motion effects, and sensory stimulation. Individuals with the following are strongly advised NOT to participate: heart conditions (including pacemaker); epilepsy or seizure disorders; back, neck, or joint issues; severe motion sickness.

Weight limit. Drivers must weigh under 220 lb — exceeding this triggers the simulator's overload protection and it will shut down.

Pregnancy advisory. Simulator participation may pose health risks during pregnancy. If you are pregnant, you are strongly advised not to participate.

Follow instructions. You must follow all posted safety rules, signage, and staff directions at all times. Do not operate, adjust, lean on, or touch the simulator or its controls except as instructed, and keep hands, feet, clothing, and belongings clear of moving parts.

Footwear & attire. Closed-toe, secure shoes are required. Not permitted: sandals, slides, clogs (e.g. Crocs), open-heel/open-toe footwear, heels/platforms, bulky boots, or bare feet/socks. Loose or unsafe footwear is not allowed and participation will be denied.

The Organizer and event staff reserve the right to refuse entry or participation to any person or group where they consider it necessary.

Acknowledgment of Risk, Waiver, Release of Liability, Covenant Not to Sue & Image Release

The following assumptions of risk, consents, waivers, and releases of liability form part of a legally binding document. Please read carefully before signing. Do not sign if unsure of the content or consequences. "Releasees" means SPUR Innovation Center Inc., their owners, directors, officers, agents, employees, contractors, event staff and volunteers, partners and sponsors, equipment manufacturers and suppliers (including Force Dynamics), the venue owners/operators, and other participants and attendees.

1. Assumption of risk. I understand that participation is inherently risky, physically demanding, and may result in serious injury and/or fatality — including, without limitation, sprains/strains, fractures, motion sickness/dizziness/vertigo/nausea/fainting, injuries involving mechanical/moving devices (contact, pinch/crush points, abrupt stops), slips/trips/falls, impacts from sudden movement/vibration, cardiac events, head or neurological injury, and the potential for permanent paralysis and/or death. While rules, equipment, supervision, and personal discipline may reduce risks, the risk of serious injury or death continues to exist.

2. Photosensitivity / epilepsy warning. Some individuals with photosensitive epilepsy may experience seizures when exposed to certain visual patterns or flashing lights. If you or a family member has an epileptic condition, consult a medical practitioner before participating; if advised against, do not participate.

3. Informed & voluntary assumption. I have fully informed myself about the Events (including the motion, vibration, emergency-stop, and entry/exit features of the Force Dynamics simulator) and knowingly and freely assume and accept all responsibility and risks, both known and unknown.

4. Voluntary compliance & hazard reporting. I will comply with all stated terms and posted safety rules and staff instructions. If I observe any hazard or feel unwell, I will immediately cease participation, press the red emergency stop if needed, and notify the nearest staff member.

5. Right to deny/terminate. The Organizer and staff may, at their sole discretion, deny, pause, or revoke participation for safety, operational, or conduct reasons. As the event is free, no compensation is owed and any session may be ended at any time.

6. Incident reporting, first aid & EMS consent. I will promptly report any accident, injury, illness, near-miss, or damage to an authorized representative. I consent to first aid by event staff and authorize the Organizer to summon EMS and arrange transport if necessary. I release and indemnify the Releasees from liability arising from such first aid, EMS response, transport, or treatment (except for gross negligence or wilful misconduct). All medical and transport costs are my responsibility; the Organizer does not provide health or accident insurance.

7. Waiver & release of liability. For myself and my heirs, executors, administrators, assigns, and next of kin, I voluntarily and forever waive, release, discharge, and covenant not to sue the Releasees with respect to any and all injury, disability, death, or loss or damage to person or property incurred in connection with my participation in or presence at the Events, to the fullest extent permitted by law — including claims caused in whole or part by the alleged negligence of any Releasee, the condition/setup/operation of the simulator or premises, sudden movement/emergency stops/power interruption, or the acts of third parties. I further agree to indemnify, defend, and hold harmless the Releasees from any losses, claims, damages, and reasonable legal fees arising from my participation or breach of the rules. Nothing releases claims that cannot legally be waived.

Responsibility for equipment damage. I am fully responsible for any damage to the simulator, equipment, property, or premises caused by my misuse, failure to follow rules/instructions, or negligent/reckless/intentional acts, and agree to reimburse the Organizer on demand for the full cost of repair or replacement (parts, labour, diagnostics, shipping, and loss of use). I acknowledge the Force Dynamics simulator is specialized, high-value equipment.

8. Attestations. Unless indicated otherwise, I attest that I am 18+ (or a parent/guardian is signing for a minor who is present); am free from illnesses/injuries/conditions that could interfere with safe participation (including the health exclusions above); am capable of safely operating the controls; am sober and not impaired; and confirm the information on this form is true, accurate, and complete.

9. Voluntary participation. My participation is entirely voluntary and I may withdraw at any time; session turns may be forfeited and no compensation is owed.

10-11. Image & likeness. I understand there are inherent risks in publication of my image online, and I assume them. I grant permission to the Releasees to photograph, film, and record me and my participation, and to use, reproduce, publish, and distribute such media together with my name, image, likeness, and voice for non-commercial promotional, editorial, and archival purposes, in any media, without compensation. No commercial sale/licensing of my likeness will occur without my separate written consent. I may withdraw this consent by written notice on a go-forward basis (not applying to already-published materials).

12. Participation by minors. If signing for a person under 18, I confirm I have entered their full legal name and date of birth, each minor is at least 13 and meets eligibility requirements, I am their parent/legal guardian or have legal authority, I have assessed the risks and voluntarily consent to their participation, I believe they are capable of participating, I will instruct them to comply with all rules, and I accept all responsibility and liability and agree to indemnify the Releasees for any claims brought by or on behalf of the minor. (If no minors are in your care, simply agree below to complete the form.)

13-15. General. This agreement is governed by the laws of Ontario, and the parties attorn to the exclusive jurisdiction of the courts of Ontario. If any portion is void or unenforceable, the remainder stays in effect. I have read this release, fully understand its terms, understand I have given up substantial rights by signing it, and sign it freely and voluntarily without inducement.
